Terms of service
1. Agreement
By engaging Curated Retreat “we,” “us,” or “our” for travel planning, advisory, and booking services, you “client,” “traveler,” or “you” agree to these Terms and Conditions.
Checking the acceptance box on our booking form, submitting a signed authorization, approving a proposal, or making any payment toward your trip constitutes acceptance of these Terms.
2. Parties to the Agreement
This Agreement is between Curated Retreat, a professional travel advisory company, and the client identified in the booking form, proposal, invoice, or travel documents.
These Terms govern all services provided by Curated Retreat in connection with your travel planning, advisory, and booking arrangements.
3. Scope of Services
Curated Retreat provides luxury travel planning, advisory, and booking services, including but not limited to:
Wellness retreats
Longevity, detox, and restorative travel programs
Luxury cruises and expedition travel
Hotel and resort stays
Milestone trips, honeymoons, and group travel
Transfers, activities, dining, and special travel arrangements
Services may include:
Personalized consultation and travel recommendation
Selection of hotels, resorts, retreats, cruise lines, or travel suppliers
Coordination of accommodations, transfers, activities, and special requests
Communication with suppliers regarding confirmations, amenities, inclusions, and logistics
Delivery of confirmations, itineraries, or travel documents through email or a secure client platform
Curated Retreat does not own, operate, manage, or control airlines, hotels, cruise lines, resorts, retreat centers, transportation companies, tour operators, wellness centers, activity providers, or any other third-party provider. All such entities are referred to in these Terms as “Suppliers.”
Suppliers are independent contractors and are solely responsible for the services they provide.
4. Planning Fees, Deposits, and Payments
A non-refundable planning fee may be required before itinerary research, supplier outreach, proposal creation, or booking work begins.
Planning fees compensate Curated Retreat for professional time, research, consultation, itinerary design, supplier coordination, and advisory services. Planning fees are separate from the cost of travel and are not applied toward Supplier payments unless expressly stated in writing.
Deposits, final payments, cancellation penalties, change fees, and refund eligibility are determined by each Supplier’s terms and conditions.
You are solely responsible for ensuring that all amounts due are paid on time in cleared funds.
Failure to pay by the stated deadline may result in:
Automatic cancellation by the Supplier
Forfeiture of deposits or prior payments
Loss of promotional pricing, availability, amenities, or inclusions
Additional fees, penalties, or fare differences
Curated Retreat may send courtesy payment reminders, but payment deadlines remain your responsibility.
If reinstatement is possible after missed payment or cancellation, you agree to pay any Supplier penalties, fare differences, administrative costs, and a $150 per traveler reinstatement fee payable to Curated Retreat.
You agree not to initiate a chargeback for cancellations, penalties, missed deadlines, non-refundable fees, or Supplier-imposed charges resulting from your failure to pay on time or comply with Supplier terms.
5. Credit Card Authorization and Chargebacks
By providing payment details, you authorize Curated Retreat and, when applicable, its authorized Suppliers or payment processors to charge your credit card for approved travel services, planning fees, deposits, final balances, taxes, fees, and other agreed charges.
Chargebacks are not permitted unless the charge is the result of verified fraud or an unauthorized transaction that was not approved by you or your authorized representative.
Unauthorized or improper chargebacks may result in:
Suspension or termination of Curated Retreat services
Cancellation of current or pending travel arrangements
Recovery of chargeback fees, administrative costs, collection costs, and legal fees where permitted by law
This section does not limit any legal rights you may have under applicable consumer protection or credit card laws.
6. Booking Accuracy and Legal Names
You are responsible for providing complete and accurate traveler information, including full legal names exactly as shown on passports or government-issued identification.
You are also responsible for providing accurate:
Dates of birth
Gender markers, where required by airlines or Suppliers
Passport information
Visa information
Known traveler numbers
Loyalty numbers
Emergency contacts
Dietary, accessibility, medical, or mobility information relevant to the trip
Name corrections, document corrections, ticket reissuance, or itinerary changes after booking may be restricted, denied, or subject to additional fees determined by Suppliers.
Curated Retreat is not responsible for errors, denied boarding, denied entry, penalties, or rebooking costs resulting from inaccurate, incomplete, or late information provided by you.
7. Pricing, Inclusions, and Service Delivery
All rates, availability, taxes, fees, inclusions, amenities, and promotions are determined by Suppliers and may change until payment is processed and the booking is confirmed.
Package inclusions may include, depending on the Supplier and booking type:
Accommodations
Meals
Wellness sessions
Spa treatments
Excursions
Cruise inclusions
Transfers
Resort credits
Hotel amenities
Taxes, fees, or service charges
Supplier-defined inclusions control. Curated Retreat is not responsible for changes, errors, expired promotions, unavailable amenities, Supplier substitutions, or differences between advertised and available offerings.
Requests for bedding, connecting rooms, early check-in, late checkout, upgrades, dietary preferences, wellness programming, spa appointments, dining times, or special amenities are requests only unless expressly confirmed in writing by the Supplier.
Refunds, credits, or adjustments, if applicable, are processed according to Supplier terms and timelines.
For transparency, travel sellers should be especially careful that pricing, mandatory fees, and material terms are clearly disclosed before purchase. The FTC’s rule on unfair or deceptive fees focuses on preventing misrepresentation and hidden fee practices in certain travel-related contexts, including short-term lodging.
8. Booking Confirmations, Reservations, and Travel Documents
You may receive confirmation documents, digital vouchers, cruise documents, hotel confirmations, transfer details, or itinerary materials directly from Suppliers or through Curated Retreat’s secure client platform.
You agree to review all confirmations, names, dates, destinations, room categories, cabin categories, flights, transfers, inclusions, and pricing promptly.
Any discrepancy must be reported to Curated Retreat in writing within 48 hours of receipt. Failure to report discrepancies promptly may limit available correction options and may result in additional Supplier fees.
9. Client Credit Card on File
You authorize Curated Retreat to securely store your credit card information through its payment processor or approved client platform for authorized travel-related charges.
Your card may be used only for:
Supplier balances approved by you in writing
Taxes, fees, or charges required by Suppliers and approved by you
Currency adjustments or surcharges disclosed by Suppliers and approved by you
Administrative fees agreed upon in writing
Planning, change, cancellation, or reinstatement fees disclosed in these Terms or otherwise agreed in writing
No unauthorized charges will be processed.
10. Authorization to Use and Share Personal Information
You authorize Curated Retreat to collect, store, process, and share necessary personal information for travel planning, booking, and trip management purposes.
This may include:
Names and contact information
Passport or government identification details
Dates of birth
Dietary preferences
Accessibility needs
Health or wellness preferences relevant to travel arrangements
Emergency contacts
Payment information
Travel preferences and loyalty details
You warrant that all information provided is accurate, current, and authorized for use.
Curated Retreat may share necessary information with Suppliers solely for travel planning, booking, servicing, or managing your trip.
11. Products and Suppliers
Curated Retreat acts solely as an advisor and booking agent for the client. Each Supplier, including but not limited to airlines, cruise lines, hotels, resorts, wellness retreats, tour operators, transport companies, destination management companies, and activity providers, is responsible for its own services, operations, staff, facilities, policies, and performance.
Curated Retreat is not liable for Supplier acts, omissions, defaults, delays, cancellations, overbookings, insolvency, bankruptcy, safety issues, service failures, or changes to services.
12. Itinerary Prices and Fees
Prices are quoted in U.S. dollars unless otherwise stated.
Depending on the trip, quoted pricing may include:
Hotel, resort, cruise, or retreat stay
Meals and beverages
Wellness sessions or spa inclusions
Activities or excursions
Local taxes and resort fees
Cruise port charges, taxes, and fees
Transfers
Airfare or airline-related charges
Final pricing may vary due to:
Supplier rate changes
Availability changes
Currency fluctuations
Tax or fee changes
Fuel surcharges
Itinerary revisions
Client-requested upgrades or modifications
Pricing is not final until the required payment has been processed and the Supplier has issued confirmation.
13. Airfare Terms, Responsibilities, and Limitation of Liability
13.1 Agency Status
Curated Retreat acts solely as a booking agent for airlines, tour operators, and air consolidators. We do not own, operate, or control any airline or air carrier.
All air transportation is subject to the applicable airline’s Contract of Carriage.
By booking airfare through Curated Retreat, you acknowledge that the airline is the provider of air transportation services and is solely responsible for flight operations, schedules, baggage handling, safety standards, seating, delays, cancellations, and service delivery.
13.2 Sources of Airfare
Airfare may be booked through:
Airlines directly
Licensed tour operators
Approved air consolidators
Cruise line or package air programs
Each booking source may have different fare rules, restrictions, cancellation penalties, payment terms, and refund policies. These rules are determined solely by the airline or ticket issuer and are beyond Curated Retreat’s control.
13.3 Schedule Changes and Airline Modifications
Airlines may change schedules, flight numbers, aircraft type, seat assignments, routes, connection times, and departure times at any time.
Curated Retreat is not responsible for:
Airline schedule changes
Flight delays or cancellations
Missed connections
Downgrades or seat reassignments
Baggage delay, damage, or loss
Denied boarding
Airline strikes or operational disruptions
Airline customer service decisions
Any compensation, refunds, credits, or claims must be pursued directly with the airline, unless Curated Retreat expressly agrees in writing to assist as a courtesy.
13.4 Client Responsibility for Passenger Accuracy
You are solely responsible for providing accurate passenger information, including:
Full legal names exactly as shown on passport or government-issued ID
Date of birth
Gender marker, where required
Passport details for international travel
Visa or entry authorization information, where required
Known traveler or frequent flyer information, if applicable
Failure to provide correct information may result in ticket reissuance fees, fare differences, denied boarding, or cancellation. Curated Retreat is not responsible for errors resulting from inaccurate, incomplete, or late information provided by you.
13.5 Fare Rules and Restrictions
Many airline tickets are non-refundable and may carry significant change penalties.
Certain consolidator, cruise air, tour operator, or promotional fares may:
Not allow name changes
Not allow advance seat selection
Not accrue frequent flyer miles
Restrict upgrades
Require immediate ticketing
Have strict cancellation or change penalties
Be subject to Supplier-specific servicing rules
Fare rules are determined by the airline or ticket issuer and must be accepted at the time of booking.
13.6 Reconfirming Flights
You are responsible for reconfirming your flight schedule directly with the airline within 24 hours of departure and again before returning home.
Failure to monitor airline changes may result in missed flights, misconnected flights, or denied boarding.
13.7 Missed Flights and Separate Tickets
If airfare is booked separately from hotels, cruises, retreats, tours, transfers, or land arrangements, you assume responsibility for any consequences of delay, cancellation, or missed connection.
This may include:
Missed cruises, tours, retreats, or transfers
Additional hotel nights
Rebooking costs
Change fees
Lost trip components
Additional ground transportation
Curated Retreat is not liable for costs arising from independently booked flights or separately ticketed itineraries.
13.8 Force Majeure and Airline Disruptions
Airlines may suspend, delay, cancel, or modify service due to events beyond their control, including but not limited to:
Weather events
Natural disasters
Government restrictions
Public health emergencies
Labor strikes
Air traffic control disruptions
Security events
Mechanical or operational issues
Curated Retreat is not responsible for airline decisions or resulting financial losses. Refunds, credits, rebooking, and re-accommodation are governed by the airline’s policies and applicable law.
13.9 Airline Insolvency
Curated Retreat is not responsible for airline bankruptcy, insolvency, or financial default. Recovery of funds may be limited or unavailable and is governed by airline, payment processor, insurance, or applicable legal processes.
13.10 Travel Insurance Recommendation
Comprehensive travel insurance that includes trip cancellation, trip interruption, travel delay, medical, emergency evacuation, and baggage coverage is strongly recommended when booking airfare.
Declining travel insurance constitutes acceptance of the financial risks associated with airline disruptions.
14. Cancellations, Changes, and Refunds
All changes and cancellations must be submitted in writing to:
Supplier penalties apply and may be up to 100% of the total trip cost.
Curated Retreat’s planning fees are non-refundable.
In addition to Supplier penalties, Curated Retreat charges:
$75 cancellation fee per traveler
$75 change fee per traveler, when a confirmed booking must be modified
$150 reinstatement fee per traveler, if a canceled booking can be reinstated
Refunds, future travel credits, or partial credits, if available, are subject solely to Supplier terms, Supplier timelines, and payment processor timelines.
Curated Retreat does not control Supplier refund processing times.
15. Unused Arrangements and Minimum Requirements
Unused portions of travel are non-refundable.
This includes, but is not limited to:
Early departures
Late arrivals
Missed transfers
Missed activities
Missed wellness sessions
Missed meals
Voluntary non-participation
No-shows
Group retreats, cruises, private experiences, or wellness programs may require a minimum number of participants. If minimum participation is not met, the Supplier may alter pricing, inclusions, dates, services, or scheduling.
16. Group Bookings
For multi-traveler bookings, private group retreats, group cruises, wedding-related travel, or hosted experiences:
Group rates and availability are confirmed only after written confirmation from the Supplier.
Minimum group sizes may apply.
If minimums are not met, pricing, availability, inclusions, or terms may change.
Each traveler is individually responsible for payment deadlines, documentation, insurance decisions, and compliance with these Terms.
A single group leader may be designated to coordinate requests and communication with Curated Retreat.
Substitutions or name changes may be permitted only at the Supplier’s discretion and may incur additional fees.
Group cancellations are subject to Supplier penalties and Curated Retreat administrative fees per traveler.
Curated Retreat is not responsible for disputes between group members, roommates, families, wedding parties, or other travelers.
17. Travel With Minors
When traveling with minors, you are responsible for complying with all airline, cruise line, border, immigration, and destination requirements.
This may include:
Valid passports
Visas or entry authorizations
Birth certificates
Consent letters
Notarized authorizations
Custody documents
Documentation required when one parent or legal guardian is absent
Curated Retreat is not responsible for denied boarding, denied entry, delays, cancellations, or financial losses due to missing, incomplete, or insufficient documentation.
18. Wellness, Health, and Participation
Wellness retreats and programs may involve physical activity, spa treatments, specialized diets, fasting, detox protocols, breathwork, heat or cold exposure, fitness classes, hiking, yoga, meditation, medical testing, or other wellness-related activities.
Participation is voluntary and at your own risk.
You are responsible for consulting a qualified physician or licensed healthcare provider before participating in any wellness, fitness, detox, longevity, medical, or health-related program.
Curated Retreat does not provide medical advice, diagnosis, treatment, or health recommendations.
Curated Retreat is not liable for:
Injury
Illness
Allergic reactions
Food sensitivities
Medical outcomes
Adverse reactions to wellness treatments
Emotional distress
Failure to achieve desired wellness results
Decisions made by wellness providers, medical personnel, or Suppliers
You are responsible for disclosing relevant health, allergy, dietary, mobility, pregnancy, or medical information directly to the Supplier when required.
19. International Travel Responsibilities
You are responsible for obtaining and carrying valid passports, visas, entry authorizations, vaccination records, health documents, parental consent documents, and any other documentation required for your trip.
You are responsible for reviewing official government resources before travel, including:
U.S. Department of State travel information and advisories
CDC Travelers’ Health destination guidance
Destination-specific visa and entry requirements
Airline, cruise line, or Supplier documentation requirements
The U.S. Department of State advises travelers to review current travel advisories, entry requirements, local laws, and U.S. embassy information before international travel. The CDC also publishes destination-specific travel health notices and vaccine guidance for travelers.
Curated Retreat is not responsible for denied boarding, denied entry, quarantine, fines, penalties, delays, cancellations, or losses resulting from failure to comply with documentation, health, visa, immigration, or entry requirements.
20. Assumption of Risk and Release of Liability
You acknowledge that travel carries inherent risks, including but not limited to:
Illness
Injury
Accident
Theft
Property loss
Weather disruption
Political unrest
Supplier failure
Transportation delays
Natural disasters
Public health events
Changes in local laws or entry rules
Wellness or physical activity risks
By booking travel, you voluntarily assume these risks.
To the fullest extent permitted by law, you release Curated Retreat, its owners, contractors, advisors, affiliates, and representatives from liability for events beyond Curated Retreat’s direct control, including those caused by Suppliers, third parties, force majeure events, or your own acts or omissions.
21. Travel Insurance
Comprehensive travel insurance is strongly recommended for all travelers and may be required by certain Suppliers.
Recommended coverage may include:
Trip cancellation
Trip interruption
Travel delay
Emergency medical care
Emergency evacuation
Baggage loss or delay
Supplier default, where available
Cancel-for-any-reason coverage, where available and eligible
If you decline travel insurance, you accept full financial responsibility for any losses, emergencies, cancellations, delays, medical expenses, or disruptions that may occur before or during travel.
Curated Retreat may require you to sign a travel insurance waiver if you decline coverage.
22. Communication
Clear and timely communication is essential to accurate travel planning.
You agree to:
Review all proposals, confirmations, invoices, and travel documents promptly
Respond to Curated Retreat requests in a timely manner
Provide complete and accurate information
Notify Curated Retreat promptly of any changes, concerns, or errors
Use the agreed communication channels for trip planning and approvals
Delays in response may affect pricing, availability, booking accuracy, supplier deadlines, or trip delivery.
23. Confidentiality and Proprietary Materials
All itineraries, proposals, recommendations, supplier contacts, planning frameworks, destination research, and proprietary materials shared by Curated Retreat are confidential and intended solely for your personal use.
You may not copy, reproduce, distribute, publish, sell, share, or use Curated Retreat materials to book independently, solicit Suppliers directly, or create competing materials without prior written consent.
24. Currency Fluctuations
Exchange rates, foreign taxes, government fees, fuel surcharges, and Supplier costs may change without notice.
The final trip cost is confirmed only once full payment has been processed and the Supplier has issued confirmation.
You are responsible for any currency-related changes, foreign transaction fees, bank fees, or credit card conversion charges.
25. Indemnification
You agree to indemnify, defend, and hold harmless Curated Retreat, its owners, contractors, advisors, affiliates, and representatives from and against any claims, losses, damages, liabilities, costs, or expenses, including reasonable legal fees, arising from:
Your breach of these Terms
Your inaccurate or incomplete information
Your failure to comply with Supplier terms
Your failure to obtain required travel documents
Your conduct during travel
Claims brought by other travelers in your party
Chargebacks, payment disputes, or collection actions resulting from your acts or omissions
26. Force Majeure
Curated Retreat is not liable for delay, cancellation, failure to perform, or non-performance due to events beyond its reasonable control.
Force majeure events include but are not limited to:
Natural disasters
Severe weather
Pandemics or public health emergencies
Government orders or restrictions
Border closures
War, terrorism, civil unrest, or security events
Labor strikes
Supplier insolvency or bankruptcy
Airline or cruise line disruptions
Transportation failures
Power, technology, or communication outages
Acts or omissions of Suppliers or third parties
If such events occur, Curated Retreat is released from contractual obligations affected by the event and is not responsible for Supplier decisions, refund delays, penalties, credits, cancellations, or additional costs.
27. Limitation of Liability and Maximum Damages
To the fullest extent permitted by law, Curated Retreat’s total liability for any claim arising out of or related to its services shall not exceed the planning fees paid directly to Curated Retreat for the specific trip at issue.
Curated Retreat is not liable for:
Consequential damages
Incidental damages
Special damages
Punitive damages
Exemplary damages
Lost profits
Emotional distress
Loss of enjoyment
Lost vacation time
Supplier errors or failures
Third-party acts or omissions
Your sole remedy for any claim against Curated Retreat is limited to the cost of advisory or planning services paid directly to Curated Retreat.
28. Reservation of Rights
Curated Retreat reserves the right to update, revise, or modify these Terms at any time.
Updated versions will apply to future bookings and may be made available through our website, booking form, proposal, client platform, or email.
Terms in effect at the time of your booking apply to that booking unless otherwise agreed in writing.
29. Governing Law, Venue, and Jurisdiction
These Terms are governed by the laws of the State of West Virginia, United States, without regard to conflict of law principles.
Subject to the arbitration clause below, any dispute that is not subject to arbitration shall be brought exclusively in the state or federal courts located in or serving Jefferson County, West Virginia.
30. Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms, Curated Retreat’s services, or any booking handled by Curated Retreat shall be resolved through confidential binding arbitration administered by the American Arbitration Association.
The arbitration shall take place in West Virginia unless the parties agree otherwise in writing.
The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Each party shall bear its own legal fees and costs unless the arbitrator determines otherwise or applicable law provides otherwise.
You and Curated Retreat waive the right to a jury trial and agree that disputes will be resolved on an individual basis only, not as a class action or representative proceeding, to the fullest extent permitted by law.
Attorney review strongly recommended: Arbitration and class action waiver clauses can be highly state-specific and should be reviewed before use.
31. Severability and No Waiver
If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
Failure by Curated Retreat to enforce any provision does not constitute a waiver of future enforcement of that or any other provision.
32. Transfer or Assignment
You may not transfer or assign this Agreement, your booking, or your rights under these Terms without written consent from Curated Retreat and any applicable Supplier.
Curated Retreat may assign its rights or obligations in connection with a business transfer, merger, restructuring, or sale, provided doing so does not materially reduce client rights under existing bookings.
33. Headings
Headings are for convenience only and do not affect interpretation of these Terms.
34. Notices
All official correspondence must be sent in writing to:

Notices are deemed received when sent by email, unless the sender receives a delivery failure notice, or when delivered by recognized mail or courier service.
35. Counterparts and Electronic Signatures
Electronic signatures, digital acceptance, checkbox acceptance, form submission, and email approval are legally binding and equivalent to handwritten signatures to the fullest extent permitted by law.
West Virginia law provides that a record or signature may not be denied legal effect solely because it is electronic, and that contracts may not be denied enforceability solely because an electronic record was used in formation.
36. Entire Agreement
These Terms, together with Curated Retreat’s Privacy Policy, applicable proposals, invoices, booking forms, Supplier terms, and written authorizations, constitute the entire agreement between you and Curated Retreat.
These Terms supersede all prior discussions, proposals, emails, representations, or agreements related to the services covered by this Agreement.
In the event of a conflict between these Terms and a Supplier’s terms, the Supplier’s terms govern the Supplier-provided services, cancellation penalties, refunds, credits, and operational decisions.
Client Acknowledgment
By submitting payment, approving a proposal, signing electronically, or selecting “I Agree,” you confirm that you:
Have read, understood, and accepted these Terms and Conditions
Authorize Curated Retreat to act as your travel advisor and booking agent
Accept responsibility for providing accurate traveler information
Understand that Suppliers are independent contractors
Understand that Supplier penalties and refund limitations may apply
Understand that Curated Retreat planning fees are non-refundable
Acknowledge that travel insurance has been strongly recommended
Accept responsibility for passports, visas, health documentation, and entry requirements
Agree to Curated Retreat’s cancellation, change, payment, and chargeback policies
Accept the assumption of risk, limitation of liability, and dispute resolution provisions contained in these Terms
